FDLE Chemist Accused Of Tampering With Evidence In 35 Counties

TALLAHASSEE (CBSMiami) –The Florida Department of Law Enforcement ordering a statewide review of crime lab drug evidence after a state crime lab chemist was relieved of duty for allegedly stealing drugs.
Jerry Bailey, the head of FDLE, made the announcement Saturday morning in Tallahassee.  The FDLE traced the situation to a chemist who worked in the Pensacola crime lab after sheriffs officers upstate reported missing evidence in several major drug cases.
“So far, we’ve identified several dozen evidence submissions where prescription drugs were substituted with over the counter medications. As you know this has the potential to impact hundreds  of drug cases across our state,” said Bailey.
Escambia County Sheriff’s Office and State Attorney William Eddins’ Office started the investigation into missing prescription pain pills from the evidence room at the Escambia County Sheriff’s Office.  Officials learned that the missing drugs had been replaced with over-the-counter medications.
Investigators were able to determine that each case with missing drugs had been analyzed by just one chemist.
That chemist has been relieved of duty.
FDLE is reviewing evidence from all cases handled by this chemist between 2006 and present.
Monday, FDLE teams will be deployed to impacted agencies to inspect all evidence handled by the chemist to confirm cases potentially compromised.  The chemist worked nearly 2,600 cases for 80 law enforcement agencies spanning 35 counties and 12 judicial circuits.

Ex-chief Of DeSoto Jail Pleads Guilty

DESOTO COUNTY – Ray Kugler, the former sheriff’s captain in charge of the DeSoto County jail, has agreed to plead guilty to lying to FBI agents — a federal felony.

According to court documents, an FBI special agent and an agent with the Florida Department of Law Enforcement interviewed Kugler June 24 as part of the agencies’ investigation into allegations of abuse and civil rights violations in the jail made by Jody Holland, a former inmate.
Holland, 43, says DeSoto deputies beat him on three occasions, slamming his head into a concrete wall, punching him in the face and chest and choking him nearly unconscious.
Sheriff’s officials — including Kugler — initially denied that any staff member used force on Holland, but the Sheriff’s Office started an investigation after being contacted by the Herald-Tribune.
The FBI, FDLE and Sheriff’s Office internal affairs detectives started several investigations. Kugler retired while being investigated. Three other jail staffers were fired. One other was disciplined.
The plea
According to the federal plea agreement, the agents asked Kugler about a request to transport Holland to a local hospital — a request Holland and others say Kugler denied.
“The questions asked, and the responses provided by Mr. Kugler, were material to the investigation of whether DeSoto County jail staff, including Mr. Kugler, were willfully and deliberately indifferent to the serious medical needs of inmate J.H. (Holland),” the plea agreement states.
Kugler denied knowledge of the conversations during which he allegedly refused medical care — assertions that investigators claimed “were false.”
“In fact, Mr. Kugler was aware of the request to transport inmate (Holland) to (DeSoto Memorial Hospital) on May 25 2013 and willfully and deliberately denied such knowledge to S/A Roncinske and Agent Walsh,” the plea agreement states.
Kugler’s lawyer, Fort Myers defense attorney Joseph Viacava, said, “Because of his lack of criminal history, the controversy over the charge itself and his numerous years of public service, it is very unlikely he will serve any jail time, which of course is up to the court.”
“The charge is disputed, but the jury could conclude he did mislead, which is unintentional,” Viacava said. “They thought he was the boss in charge of all this, because he had the original dispute with the guy over some remarks, but they found out he had nothing to do with it.”
Viacava would not allow Kugler to be interviewed by the Herald-Tribune while the sentence is pending.

Moving forward
Holland said he expects more indictments in the case, which has been before a grand jury.
“I want the people who smashed my head — who tried to kill me,” he said. “I am glad it is moving forward.”
Holland said he is still suffering the effects of a mild concussion and from Post Traumatic Stress Disorder as a result of the beatings.
Deputies arrested Holland on April 21 for allegedly battering his girlfriend, Christine Routson, a nurse who worked at the jail until she resigned while under investigation.
Holland has denied the charges.
He spent the night in jail after that April arrest and was later released subject to a domestic violence injunction that ordered him to stay away from Routson.
She has alleged that Holland violated this court order on at least three occasions.
Holland was arrested May 25 on charges of violating the injunction and taken to the DeSoto jail, where he claims the more serious assaults began.

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
I think that pepper spraying someone until their body is too toxic for medical staff to touch is cruel but in Lee County it is business as usual.
The District 21 Medical Examiner ruled his death was a homicide because he had been restrained and sprayed with pepper spray by law enforcement officers. But to this day, nobody has ever been charged with a crime, and the Lee County State Attorney cleared the sheriff’s office of any wrong doing.
 FDLE refuses to reopen the case.
We have to be the ones to stay ENOUGH!
Please sign this petition to have the case opened and people held accountable for Nick’s death. When the light is shined directly on the Lee County Jail, the sheriff and the state of Florida then all of the inmates there will be less likely to be tortured. We have to expose the monsters.

I also ask that you contact our governor, tell him as the governor of the state of Florida he has a responsibility to protect all of our citizens, and to uphold the US and FL constitution as he swore in his oath of office. If he allows Lee County to continue their reign of terror he is just as responsible as the ones actually torturing and killing others.

The Florida Department of Law Enforcement’s (FDLE) Orlando Regional Operations Center arrested Joseph Wiggins, 38, of Sanford, Fla. for one count of bribery and one count of accepting unlawful compensation. Wiggins is an officer with the Sanford Police Department.

The investigation began in July when the Sanford Police Department asked FDLE to look into allegations that Wiggins had solicited a bribe from an individual during traffic stop in June. The investigation found that Wiggins had solicited the driver and accepted money in exchange for not writing a ticket or taking the driver into custody.
Wiggins was booked into the Seminole County Jail. The case will be prosecuted by the Office of the State Attorney, Eighteenth Judicial Circuit.

Influential Florida Blogger Calls On Governor Rick Scott To Reopen Honor Killing Case

 Florida's most influential and powerful blog, The Shark Tank, has taken up the call for justice in the cover-up of the honor killing of Fatima Abdullah. Javier Manjarres is calling upon Governor Rick Scott to call for a special investigation in the murder of Muslim woman in Florida.


Tampa Police and the Medical Examiners office ruled Fatima Abdallah's honor killing a "suicide," saying she beat her own head against a coffee table until she died. Tampa Rescue called the TPD explanation illogical and said that she looked as if someone beat her to death. There was a history of systematic abuse by her family. Fatima was quoted as telling a neighbor that her brother did "unspeakable things to her."
We continue to search for one decent human being with integrity in a position to investigate -- to do the right thing. We contacted Doug Culbertson of the FDLE, Medical Examiners Commission. He passed the buck.  A well-placed source in the medical examiner's department  told me that a number of people had expressed grave concern at Laura Hair's decision to classify the death of Fatima Abdallah as a suicide, and thanked us profusely for holding a rally and for demanding

We called on Mark Ober, State Attorney,  Karen Stanley, Chief Assistant State Attorney, Bob Buckhorn, Mayor of Tampa, Santiago Corrada,  Tampa Mayor Chief of Staff, but they hid under their desks.
We rallied and protested.
We asked Dr. Vernard Adams, Chief Medical Examiner in the Hillsborough County Medical Examiners office (the office that called Fatima's death an accidental suicide) to re-examine the overwhelming evidence of murder. We asked the Medical Examiners commission to investigate, but Glenn Hopkins of the Florida Department of Law Enforcement's Medical Examiner's Commission refused to reopen or rexamine the manner of death. They, too, silently sanctioned the sharia (whatever happened to first do no harm?). Over 4,000 concerned citizens sent emails urging the Tampa Police Department and State Attorney Mark Ober to reopen this case. These officials have ignored the public outcry because it is politically expedient and sharia compliant to cover up the potential Islamic cultural involvement.
Hundreds asked Pam Bondi to get involved.
We rallied and protested.

We need an an outside investigation of local officials. In order to get that ball rolling, please contact Governor Rick Scott's  Office. The Governor has the power to appoint what is known as a special prosecutor to investigate criminal allegations outside a state attorney's normal circuit when there are concerns about possible conflicts of interest. The Governor can also direct the Florida Department of Law Enforcement (FDLE) to perform special investigations and investigations on public officials and agencies.  If Florida law enforcement agencies are reluctant to investigate and aggressively pursue charges in the context of honor killings for fear of reprisal, it means that we are effectively being governed by the vile precepts of Sharia that these command honor killings.  Our communities should stand united, break through the silent complicity of family members that too often attends these killings, and pursue justice.
Attorney General Pam Bondi’s attention was also solicited on this case, and her office issued the following reply-

 Upon reviewing the crime scene investitgation images, it was obvious the injuries Abdallah sustained to her face and head, not to mention the broken rib(s) that was not a ‘suicide-by-coffee-table’, but a murder case that needs to be reopened. Also in reviewing the notes and documents regading the case, it was also troubling to learn that the of the 5 family members present, it took all of them 2 1/2 hours before they called 911, and then gave conflicting stories as to what happened to Fatima.


With all of the evidence in the case pointing towards murder and not towards an accident or suicide, pressure must be brought on Florida authorities to revisit the determination that he 48 year-old Abballahs’ death was an “accidental suicide” and to bring the perpetrators of this crime to justice.  As it presently stands, this case can only be reopened by Governor Rick Scott via a special prosecutor.  We strongly urge Governor Scott to review this case and order an investigation into the highly questionable conclusions that have been reached thus far by the various branches of Florida law enforcement.
